Damages in cases of bodily injury

in English The final thesis mainly deals with the description and evaluation of the development of civil legislation on compensation for non-pecuniary damage to health in connection with the adoption of the New Civil Code. The main purpose of the thesis is to analyse the manner of determining the amount of reparation of non-pecuniary damage, including comparisons of the compensation according to the Methodology of the Supreme Court with the previous system of compensation in connection with non-material injury. The first chapter approaches the theoretical background important for the establishment of the obligation to compensate non-material damage, mainly legal tort liability and the related preconditions for its emergence, i.e. the unlawful conduct, formation of the damage, causation and fault. Next chapter describes the individual claims included in non-pecuniary damage, i.e. claims for suffered pain, social impairment and mental suffering, including discussion whether these claims remain individual under the New Civil Code. Civil law aspects of health protection

The subject of this paper is the civil law aspects of health protection. The aim of the thesis is to analyse the relevant law concerning the topic and compare it to regulation suggested in the new civil code. Considering the breadth of the topic, the thesis does not deal with all aspects of this issue but just focuses on some of the most debatable questions. Not only the current law and related literature is considered, but a particular emphasis is also put on related case law. In some parts the paper also takes into consideration the fundamental masterpiece of European tort doctrine - Principles of European Tort Law (PETL). The thesis is composed of five chapters, each of them dealing with different aspects of the topic. Chapter One provides an outline of relevant Czech and international law. Chapter Two analyses the concept of right to health protection as a part of personality protection and deals with its object, content and subjects. Chapter three is devoted to the unlawful infringement of the right to health protection and its consequences. Chapter Four focuses on civil law responsibility for unlawful infringement and on the circumstances which are necessary for the responsibility for injury to health to arise and also on the subjects to this responsibilty. Monetary satisfaction as a legal tool for the protection of personal rights under civil law

1 Abstract: The subject of this paper is the issue of the pecuniary satisfaction as a legal instrument of protection of the personality in civil law. It is obvious that the main object of this work is the question of personal rights and its protection, which has its part in constitutional laws. This paper also analyses the definition of law on protection of personality, an entitlements to sue and to be sued relating to protection of personality. This essay is divided into five chapters with relatively separated thesis. In the first part the issue of conception of personality is analysed. What is personality in the terms of law? There are two different views - in first personality is identical with human existence, in second view personality is only role assignated to human by system of law. This part of the work analyses especially socialistic view of person and its protection and iusnaturalistic conception of personality. Both of them have practical impacts on legislation in Czechoslovakia and in Czech Republic as well. Anthropological conception respects new proposal of Civil code, while socialistic view and its basics exerts influence up recent Civil Code nr. 40/1964. The purpose of my thesis is to analyze the moral and material satisfaction in Czech civil law. It provides a deep interpretation of these institutes which represent an important phenomenon in our time. The importance of protection of personality increased in the 20th century in connection with development of human and personal rights. In last years also according to mass media and global society. The aim was not only to give the interpretation of basic institutes and instruments of protection of personality but also to show more extensive circumstances of this topic, set into relevant judicial cases and European aspects. It goes from an introduction to moral and material satisfaction, basic institutions relating to the protection of personality, moral and material satisfaction, history, constitutional law, criminal law, administrative law to presumptions of remedying of protection of personality, the aspects of time perspective, proposal of new Czech civil code, changes to be made in legislation and conclusion.
Immaterial harm in civil law

This thesis deals with the legal regulation of immaterial harm (non-pecuniary loss) in civil law with a necessary extension to other spheres of private and public law. Immaterial harm reflects the personal loss caused by the infringement of human personal rights or other natural rights protected by law. There is no possibility of objective pecuniary evaluation in comparison to the material harm (damage) and so there is no potentiality to recover damages easily. The main goal of the thesis is to compose crucial issues regarding immaterial harm. The thesis uses mainly analysis of primary and secondary sources such as legal regulation, professional literature and judicial decisions. The immaterial harm is linked to the two main areas of law: 1) tort law and 2) the protection of person and personal rights. So the thesis is divided into two parts for that important reason. The first part of the thesis deals with the common regulation of the immaterial loss. Legal provisions encompassing immaterial harm are regulated in the first chapter. This thesis is focused on immaterial harm in civil law. An immaterial harm is very topical issue, especially because it arises primarily through interferences with personality rights and the persons concerned feel this harm more intense than material damage. The thesis tries to give a comprehensive overview of all aspects of immaterial harm. It's based on effective legislation, especially the Law no. 89/2012 Coll., Civil Code. In the first part the thesis deals with the theoretical description of immaterial harm and the definition of the basic terms connected with it. The current relevant legal regulation and an overview of the historical development of the legal regulation of immaterial harm with an emphasis on the territory of the Czech Republic are presented here. Part of the theoretical part is also an overview of the changes that occurred in the law of immaterial harm in 2014 after the entry into force of the new Civil Code. Damage to health as an interference with personal rights protection The purpose of this thesis is to describe the kinds of claims arising to the damaged parties in cases of unjustified interference with personal rights, especially in cases of bodily harm. This thesis comprises four chapters, where the first chapter provides brief overview of the legislation regulating personality rights and rights to protection of health in the Czech Republic. Chapter two provides more detailed overview of personality rights and rights to protection of health of an individual in the current Civil Code and it also serves as theoretical basis for the following chapters. Chapter two especially describes the content of personality rights and rights to the health of the individual, and identifies the parties entitled to sue and having the capacity to be sued. Chapter two also describes the circumstances under which the interference with the protection of personality is permissible and also the means of protection of personal rights which the damaged individual has.
